Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("Customer", "you") and Everon d.o.o., a limited liability company registered in Bosnia and Herzegovina, registration number 2738466293840, with its registered office at Kožara 12A, Brčko distrikt, Bosnia and Herzegovina ("Everon", "we", "us", "our").
By creating an account, placing an order, or using any service provided by Everon (the "Services"), you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and our Acceptable Use Policy. If you do not agree, do not use the Services.
1. Definitions
- Services — web hosting, domain name registration, email, backups, related products and any other service we make available through https://everon.one or https://panel.everon.one
- Account — your customer account in our billing system at https://panel.everon.one
- Content — any data, files, code, websites, databases, emails, or other material you store, transmit, or process through the Services.
- Order — an individual product or service you purchase from us.
- Billing Cycle — the recurring period for which the Service is paid (monthly, quarterly, annually, etc.).
2. Eligibility
2.1. You must be at least 16 years old to enter into this agreement. If you are between 16 and 18, you confirm that you have your parent's or legal guardian's permission to do so, and that your parent or guardian agrees to be bound by these Terms on your behalf.
2.2. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2.3. You must provide accurate, complete, and up-to-date information when creating an Account. You are responsible for keeping your contact details, especially your email address, current.
3. Account Security
3.1. You are responsible for all activity that occurs under your Account and for keeping your login credentials confidential.
3.2. You must notify us immediately at info@everon.one if you suspect unauthorised access to your Account.
3.3. We are not liable for losses arising from unauthorised use of your Account where you failed to protect your credentials.
4. Services and Service Levels
4.1. We will use commercially reasonable efforts to provide the Services with high availability. We target 99.9% network uptime measured monthly, excluding scheduled maintenance and events beyond our reasonable control (Section 13).
4.2. Service descriptions, resource limits, and features are published on https://everon.one and in your Account dashboard. We may update these from time to time; material changes will be notified in advance.
4.3. "Unlimited" features (such as bandwidth or storage on shared hosting plans) are subject to fair use and the Acceptable Use Policy. They are not intended for resource-abusive workloads (file mirrors, backup dumps from other providers, video streaming farms, crypto mining, etc.).
4.4. We may suspend or rate-limit accounts whose resource usage materially impacts other customers on shared infrastructure. We will normally contact you first; in cases of severe abuse, security risk, or legal demand we may act immediately.
5. Domain Names
5.1. Domain name registrations are processed through our registrar partner (currently ResellerClub / LogicBoxes) and are subject to the policies of the relevant registry and ICANN.
5.2. Domain registration fees are paid immediately to the registry and are non-refundable under any circumstances, including order cancellation, account termination, or domain transfer.
5.3. You are responsible for providing accurate WHOIS contact data and for responding to registry verification requests. Failure to respond may result in domain suspension by the registry.
5.4. We are not liable for domain registration failures caused by registry restrictions, registry downtime, or third-party trademark claims.
6. Orders, Pricing and Payment
6.1. Prices are displayed on https://everon.one in EUR (€) and exclude any taxes that may apply.
6.2. Services are billed in advance for the Billing Cycle you select. Payment is required before the Service is provisioned.
6.3. We currently accept payment via PayPal (including guest debit/credit card payments processed by PayPal). Stripe and other methods may be added in future.
6.4. Renewals are not charged automatically (PayPal recurring billing / Vault is not available in our region). You will receive renewal invoices by email 15 days, 7 days, and 1 day before the renewal date. You must pay the invoice before the renewal date for service continuity.
6.5. If a renewal invoice is not paid by the due date, we may suspend the Service. After a further 15 days of non-payment, the Service may be terminated and the data deleted. Domains may enter the registry's redemption period, which carries additional restoration fees set by the registry.
6.6. We may change prices for renewals with at least 30 days' notice before the renewal date.
7. Refunds
The terms under which refunds are issued are set out in our Refund Policy, which forms part of these Terms.
8. Customer Content and Responsibilities
8.1. You retain all ownership rights in your Content. We do not claim any ownership over it.
8.2. You grant us a limited, non-exclusive licence to host, copy, transmit, back up, and process your Content solely to provide the Services.
8.3. You are solely responsible for:
- the legality of your Content and the way it is used;
- obtaining all licences and rights required for any software, plugins, themes, media or other material you install;
- keeping software you install (WordPress, plugins, themes, custom applications) up to date and secure;
- maintaining your own backups in addition to any backups we provide.
8.4. You must comply with the Acceptable Use Policy. Breach is a material breach of these Terms.
9. Backups
9.1. We perform routine backups of shared hosting accounts as an operational courtesy. These backups are intended for our own disaster recovery purposes and are provided without warranty.
9.2. We may, at our discretion, restore data from our backups on customer request. We make no guarantee as to backup frequency, retention period, completeness, or restorability.
9.3. You remain responsible for maintaining your own independent backups of your Content.
10. Suspension and Termination
10.1. We may suspend or terminate your Services immediately, without notice, if:
- you materially breach these Terms, the AUP, or applicable law;
- your account is involved in security incidents (compromised sites, malware distribution, phishing, spam, brute-force attacks);
- payment is overdue (subject to Section 6.5);
- we receive a valid legal order to do so;
- your activity threatens the security, stability, or reputation of our infrastructure.
10.2. You may cancel any Service at any time from your Account at https://panel.everon.one Cancellation takes effect at the end of the current Billing Cycle unless you request immediate cancellation.
10.3. Upon termination, your Content may be deleted within 15 days. We are not obliged to retain it beyond this period.
11. Intellectual Property
11.1. The Everon name, logo, website, documentation, and platform code are owned by us or licensed to us. You are granted no rights in them other than the right to use the Services in accordance with these Terms.
12. Warranties and Disclaimers
12.1. The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties (express, implied, or statutory) including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
12.2. We do not warrant that the Services will meet your specific requirements or that any defect will be corrected.
13. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to: natural disasters, war, civil unrest, terrorism, pandemics, government action, internet backbone failures, undersea cable cuts, distributed denial-of-service attacks, upstream provider outages, or third-party software defects.
14. Limitation of Liability
14.1. To the maximum extent permitted by law, our total aggregate liability to you for any claims arising out of or relating to these Terms or the Services is limited to the total amount you paid us for the affected Service in the 12 months preceding the event giving rise to the claim.
14.2. In no event are we liable for: lost profits, lost revenue, lost data, lost goodwill, business interruption, or any indirect, incidental, special, consequential or punitive damages, even if we have been advised of the possibility of such damages.
14.3. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for gross negligence, wilful misconduct, or death/personal injury caused by our negligence.
15. Indemnification
You agree to defend, indemnify, and hold harmless Everon, its directors, employees, and contractors from any third-party claims, liabilities, damages, losses, and costs (including reasonable legal fees) arising out of: (a) your Content, (b) your breach of these Terms or the AUP, (c) your violation of any law or third-party right.
16. Changes to these Terms
16.1. We may update these Terms from time to time. The "Last updated" date at the top will reflect the latest revision.
16.2. We will notify you of material changes by email or via your Account at least 30 days before they take effect. Continued use of the Services after that date constitutes acceptance.
17. Governing Law and Jurisdiction
17.1. These Terms are governed by the laws of Bosnia and Herzegovina, without regard to conflict-of-law principles.
17.2. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the competent courts of Bosnia and Herzegovina.
17.3. Nothing in this section deprives EU-resident consumers of any mandatory protections afforded by the law of their country of habitual residence.
18. Miscellaneous
18.1. Entire agreement. These Terms, together with the Privacy Policy, Refund Policy and AUP, constitute the entire agreement between you and us.
18.2. Severability. If any provision is held unenforceable, the rest of these Terms remain in effect.
18.3. No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
18.4. Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or to a successor in a merger, acquisition, or sale of assets.
18.5. Notices. Legal notices to us must be sent to info@everon.one and, where required, by registered mail to our registered office. Notices to you will be sent to the email address on your Account.
